
Georgia's Constitutional Court lifts ban on Gay blood donation

On 17th of December, the Constitutional Court of Georgia declared 10 year ban on blood donation for MSM and Gay men as unconstitutional.
Claimants were arguing that the restricted period for MSM and Gay men was longer than it was necessary for safe donation of blood, therefore it was discriminatory towards one specific group.
Consequently, the Court declared that 10 year ban on blood donation for MSM and Gay men exceeded the so called "window period" for HIV transmission and therefore, overruled the previously issued decree of Ministry of Health.
Ministry of Health of Georgia banned blood donation for MSM and Gay men in 2000.
